1. Organiser and scope
1.1 The organiser of the UNiDANZA festival and the contracting party for all purchases is:
Verein für Tanz und Kultur in Hamburg e.V.
Sachsentor 13, 21029 Hamburg, Germany
Register court: Amtsgericht Hamburg, registration number VR 21797
Represented by the board: Luis Carlos Simoes Duarte
VAT identification number: DE294744622
Email: contact@unidanza.de
Telephone: +49 176 49653700
1.2 These terms apply to all contracts concluded through unidanza.de, or through our authorised promoters, for:
- festival passes (Full Pass, Day Pass, Party Pass)
- bootcamps
- the city tour
- lunch boxes
- related services
1.3 A consumer is any natural person who enters into the contract for purposes that are mainly outside their trade, business or profession (§ 13 BGB). A trader is any person acting in the exercise of their trade, business or profession (§ 14 BGB).
1.4 The customer’s own terms do not apply unless we have agreed to them in writing.
2. Conclusion of contract
2.1 The tickets shown on our website are not a binding offer. They are an invitation to place an order.
2.2 By clicking the order button you submit a binding offer to purchase the items in your basket. Before you submit, you can review and correct your entries at any time using your browser and the basket functions.
2.3 We confirm receipt of your order by email immediately after you send it. This confirmation of receipt is not an acceptance. The contract is concluded when we send you a separate order confirmation or your ticket, or when we carry out the order.
2.4 We store the text of the contract and send it to you by email together with these terms. It is not accessible to you through our website after the order.
2.5 The contract language is English.
3. Prices and payment
3.1 All prices are final prices and include any statutory value added tax.
3.2 Payment is made through the payment methods offered at checkout. Payment is due immediately when the contract is concluded.
3.3 Where we offer a reduced price for a limited period (early bird or tiered pricing), the reduced price applies only if payment is received within that period. If payment is received later, we may charge the difference to the price tier in force at that time.
3.4 Discount codes are valid only for the period and the products stated. They cannot be combined unless this is expressly permitted, and they cannot be paid out in cash.
4. Right of withdrawal
4.1 Festival passes, bootcamps and the city tour are contracts for services connected with leisure activities, for which we set a specific date or period of performance. Pre-ordered lunch boxes are a supply of food for a specific date. For these contracts there is no statutory right of withdrawal (§ 312g (2) no. 9 BGB).
4.2 If you order physical goods that are shipped to you, the ordinary statutory right of withdrawal applies. The withdrawal instructions provided at the time of that order apply.
4.3 Our voluntary rules on cancellation and ticket transfer are set out in our Cancellation Policy, which forms part of these terms.
5. Ticket transfer, changes and cancellation by us
5.1 You may transfer your ticket to another person. To do so, notify us at contact@unidanza.de of the names and email addresses of both the original and the new ticket holder, no later than 15 days before the festival begins.
5.2 We may refuse an order before we accept it. In that case no payment obligation arises, and we refund any amount already paid without delay.
5.3 We may change the programme, the instructors, the rooms or the venue where this is necessary for organisational reasons, is reasonable for you, and does not change the overall character of the festival. We will tell you about significant changes in good time, normally by email.
5.4 If a bootcamp does not reach the minimum number of participants needed to run it, we may cancel that bootcamp. We will refund the price paid for it in full.
5.5 If we cancel the festival, we will refund the price you paid. Instead of a refund, you may choose to keep your ticket for the next edition of UNiDANZA. Your other statutory rights remain unaffected.
6. Admission, workshops and code of conduct
6.1 Admission requires a valid ticket, printed or on a mobile device. Without a valid ticket, admission will be refused.
6.2 At your first check-in you receive a wristband. You must wear it visibly for the whole event. If you lose it, we may ask you to show your ticket and proof of identity again before you are readmitted.
6.3 Workshop levels are specific to each dance style. Our instructors may ask a participant to move to a workshop at a more suitable level if this is necessary for the class to run properly.
6.4 If you register without a partner, we cannot guarantee you a dance partner. Whether partners rotate during a class is up to the instructors and participants.
6.5 Participants are expected to treat others with respect. Harassment, discrimination and disruptive behaviour are not tolerated.
6.6 We may exclude a participant from the event if their conduct seriously disrupts the event or endangers others. Where a warning is reasonable in the circumstances, we will give one first. In that case no refund is owed. You keep the right to prove that we suffered no loss, or a substantially smaller loss.
6.7 Filming workshop content is not permitted unless the instructor or the organiser has agreed in advance.
7. Photography and film at the event
7.1 Photographs and video recordings are made at the festival and may be used for documentation and for our own publicity. The legal basis is our legitimate interest in documenting and promoting the event (Art. 6 (1) (f) GDPR).
7.2 You may object at any time to the use of recordings in which you can be identified, by writing to contact@unidanza.de. Details are set out in our Privacy Policy.
8. Liability
8.1 We are liable without limitation for damage arising from injury to life, body or health caused by a breach of duty by us, our legal representatives or our agents. The same applies to damage caused intentionally or by gross negligence.
8.2 For slight negligence, we are liable only where we breach a material contractual obligation. This is an obligation that must be fulfilled for the contract to be performed properly and that you can normally rely on. In that case, our liability is limited to the foreseeable damage typical for this type of contract.
8.3 Any further liability is excluded. Liability under the German Product Liability Act and under any guarantee we have given remains unaffected.
8.4 Within the limits set out above, you take part in dance activities at your own risk. We recommend that you have your own insurance for your personal belongings.
9. Intellectual property
All content on this website, including text, graphics, logos, images and video, is protected by copyright. Any use beyond what the law permits requires our prior written consent.
10. Amendments to these terms
We may amend these terms for future contracts. The version in force when you place your order applies to that order. We will not change the terms of a contract already concluded without your agreement.
11. Dispute resolution
11.1 We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
11.2 Your statutory rights, including your right to go to court, are unaffected.
12. Applicable law and place of jurisdiction
12.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another EU Member State, this choice of law does not take away the protection of the mandatory provisions of the law of that State.
12.2 If you are a trader, a legal person under public law or a special fund under public law, the place of jurisdiction is Hamburg. For consumers, the statutory rules on jurisdiction apply.
13. Severability
If any provision of these terms is or becomes invalid, the remaining provisions remain valid.
